Notice Submitting Cleveland Division of Police Policies on Interaction with Transgender, Intersex, and Gender Non-Conforming Individuals and Interactions with Youth

The Monitoring Team submitted two recently finalized draft policies that are of significant importance to the City of Cleveland and its communities:

While not specifically mandated by the Consent Decree, these policies support the Community and Problem-Oriented Policing values set forth in Paragraph 27 of the Consent Decree, requiring CDP to “develop and implement a comprehensive and integrated community and problem-oriented policing model in order to promote and strengthen partnerships within the community,” and specifically “including how to establish partnerships and actively engage civilians and community organizations, including youth, LGBT…communities.”

As noted in the Eighth Semiannual Report, these policies are welcome examples of good collaboration between the CDP and the Community Police Commission. The policies were reviewed by the Monitoring Team, the Department of Justice, and the Community Police Commission over many months, with the majority of substantive feedback incorporated into the final draft policies.

City of Cleveland’s Ninth Status Report

Overview of Report

Paragraph 387 of the Consent Decree provides that on a semi-annual basis, the City of Cleveland is to file a status report with Court. The City’s Ninth Status Report describes the steps taken by the Cleveland Division of Police (CDP) during the reporting period to comply with this Agreement, CDP‘s assessment of the status of its progress, plans to correct any problems, and response to concerns raised in the Monitor‘s previous semi-annual report.

Response to Concerns Raised in the Monitor’s Semi-Annual Report

The City‘s response to the Monitor‘s concerns addressing the relationship of the City and CDP with the CPC is contained in the Community Engagement part of this Report. The City continues to meet and work with the CPC and remains committed to the principles of community policing and community engagement. 

The Monitor has expressed a concern that CDP continues to lack the technology and data necessary to allow officers to report the basic information required to provide the data that is needed to analyze and assess the Department‘s performance. The City believes that much of this concern has been addressed and that the acquisition of necessary data will be collected and made available. Insuring CDP‘s ability to capture relevant information by way of electronic input into an accessible data base through forms developed for used by officers has required much effort and technical work with the City‘s software provider. As noted above the City believes that much of the necessary work has now been completed and that the technology and data necessary for the Monitor‘s compliance assessment will be available. The City will continue to work with the Monitor to ensure this capability.

“The court will hold a status conference on the record with council for the parties in the within case on July 14, 2020 at 3:00 p.m., regarding the Monitor Hassan Aden’s (“Monitor”) audit of disciplinary decisions made by the Director of Public Safety, the implementation of the Cleveland Division of Police Force Review Board Training in light of the Monitor’s qualifications and concerns, (see EFC No. 314), and the status of the Monitor’s review of the use of force during recent protest activity, (see ECF No. 315). The conference will be held remotely given the court’s General Order 2020-08 and concerns regarding the ongoing COVID-19 pandemic. Videoconference information shall issue in a separate Order. The parties, council for the parties, and the Monitor shall be in attendance. Counsel for the parties and the Monitor shall be prepared to discuss progress to date under the Consent Decree, as well as any outstanding issues.”

It is being issued during an unprecedented time. Even as the nation was making its way through the COVID-19 pandemic, it is now grappling with the ongoing realities of systemic racism in all its forms – especially in policing.

Monitoring Team’s 7th Semiannual Report

This Seventh Semiannual Report focuses on ongoing progress of the Cleveland Division of Police (“CDP”) under the Consent Decree.
It reports on the continued development of critical policies and procedures for the Division under the Consent Decree and also on the delivery of several important trainings including: Use of Force, Community Engagement and Problem-Solving (“CEPS”), Bias-Free Policing, Crisis Intervention, and Search and Seizure – aimed at translating those policies into practice.

The report also addresses the creation of critical partnerships within the community and City for ensuring that the Division is expanding its capacity to be inclusive and transparent with its activities, engaging constructively with stake-holders, and remaining accountable to the communities of Cleveland.

OPS Status Report

September 9, 2019

As was noted in the City’s prior report to the Court (Dkt. 245), two major goals were established last year relative to completing work on complaints received by the City’s Office of Professional Standards (“OPS”). The first goal remains ensuring that OPS stays current in completing the necessary reviews and investigations for complaints received by OPS after December 1, 2017. Presently, OPS employs eight permanent investigators and one temporary investigator for this purpose.

Order Approving 3rd Year CIT Curriculum

July 8, 2019

Currently pending before the court in the above-captioned case is Monitor Matthew Barge’s (“Monitor”) Motion to Approve Cleveland Division of Police’s Proposed Third-Year Crisis Intervention In-Service Training Curriculum (“Proposed Training Curriculum”) (ECF No. 263). The Monitor’s Motion indicates that the Proposed Training Curriculum was reviewed on an ongoing basis by the Parties and the Monitoring Team. Pursuant to the recommendation of the Monitor that the court approve the Cleveland Division of Police’s Proposed Training Curriculum, the court hereby approves said curriculum, which meet the terms of the Consent Decree. Accordingly, the court orders said curriculum to be effective immediately.

Motion to Approve 3rd Year Crisis Intervention In-Service Training Curriculum

Pursuant to Paragraph 143 of the Consent Decree and the Revised Fourth-Year Monitoring Plan in the above-captioned matter, the City of Cleveland (the “City”), on behalf of the Cleveland Division of Police (“CDP” or “Division”), submitted to the Monitoring Team a PowerPoint presentation on Recognizing and Responding to Traumatized Youth, with accompanying Lesson Plan and Instructor’s Manual; and a PowerPoint presentation on Crisis Policy Update with an accompanying Instructor’s Manual (together, the “Proposed Crisis Intervention Training Curriculum” or “Proposed Training Curriculum”), attached hereto as Exhibits A and B, respectively.

Motion to Approve 4th Year Monitoring Plan

March 18, 2019

Because the Parties have made good on completing needed policies and plans, the Fourth Year Plan appropriately shifts much of the Parties’ and Monitoring Team’s attention to the real-world implementation of now-completed and approved policies and plans. The Plan also details a host of important officer training initiatives necessary to establish new expectations and norms across all CDP members. Accordingly, the Monitoring Team and Parties respectfully request that the Court approve the Fourth Year Plan.
